TERMS & CONDITIONS
These Terms & Conditions govern your use of the Design Centre website and all sales of goods by Design Centre:

This website may be used for personal, private, informational, and non-commercial purposes only.
You agree not to:
Use the website for unlawful purposes
Interfere with website security or functionality
Upload or transmit viruses or harmful material
Copy, reproduce, or exploit website content without written permission
Design Centre reserves the right to restrict or terminate access to the website at any time.
3. Website Content & Accuracy
All website content is provided for general information purposes only. While reasonable care is taken to ensure accuracy, Design Centre makes no warranties that product descriptions, pricing, specifications, images, or availability are complete, current, or error-free.
Product images are illustrative and may vary due to manufacturing processes, finishes, or lighting.
4. Conditions of Sale – General
All goods are sold strictly in accordance with:
Design Centre’s standard specifications applicable to such goods, and
These Terms & Conditions (Conditions of Sale).
No variations to these Conditions of Sale, and no contrary stipulations by the Buyer, shall be valid unless expressly accepted in writing by a Director of Design Centre.
5. Orders
Orders shall be binding on Design Centre only if:
Made in writing, and
Accepted by Design Centre in writing or fulfilled by delivery of the goods and submission of an invoice.
Unless a specific delivery date is stated in the Buyer’s order and expressly accepted by Design Centre in writing, all orders are accepted for delivery as and when goods become available.
Design Centre reserves the right to execute orders in whole or in instalments.
6. Pricing
Unless a definite price has been expressly confirmed in writing by Design Centre, the list price ruling at the date of delivery shall apply.
Where delivery is made in parts, the list price ruling at the date of each part delivery shall apply to that part.
Where a definite price has been confirmed in writing, such price shall nevertheless be subject to increase should Design Centre’s list price increase prior to delivery or part delivery. Any such increase shall be:
Communicated to the Buyer, and
The Buyer shall be entitled to cancel the order in writing prior to delivery or within 14 (fourteen) days of notice of the increase, without penalty to either party.
7. Value Added Tax (VAT)
If the rate of Value Added Tax is amended prior to delivery of goods, the agreed price shall be adjusted accordingly. The amended price shall automatically become the agreed price without the need for further notification.
8. Payment Terms
Unless otherwise agreed in writing by a Director:
Payment for goods shall be due net and without deduction within 30 (thirty) days from the date of the statement on which the purchase first appears.
Interest shall accrue on overdue amounts at 2% (two percent) per annum above the prime overdraft rate quoted by First National Bank at the time.
If any payment is not made on the due date, the full outstanding balance shall immediately become due and payable.
Where orders are executed in instalments, payment for each instalment shall be due in accordance with this clause from the date of the relevant statement.
Design Centre shall have no obligation to supply goods while the Buyer is in arrears on any account.
9. Delivery & Risk
Risk in the goods shall pass to the Buyer upon delivery.
Design Centre reserves the right to select routes and modes of transportation, taking the Buyer’s preferences into account where reasonably possible. Any additional costs incurred shall be for the Buyer’s account.
Design Centre shall not be liable for late delivery or non-delivery due to force majeure or any circumstances beyond its control, and accepts no responsibility for any loss or damage arising therefrom.
10. Inspection, Returns & Claims
The Buyer is required to inspect goods upon delivery to verify quantity and specification.
Goods may not be returned, and deliveries may not be refused, except by prior written arrangement with a Director of Design Centre.
If goods do not conform to specification, the Buyer must notify Design Centre in writing within 14 (fourteen) days of delivery.
Where valid, Design Centre may either:
Replace the defective goods, or
At its discretion, accept return of undamaged goods and refund the purchase price.
Claims relating to shortages must be made within 7 (seven) days of delivery and must be supported by evidence satisfactory to Design Centre.
11. Limitation of Liability
Design Centre shall not be liable for any damages, losses, or claims (whether direct, indirect, or consequential) arising from:
The supply of goods
Use of goods
Delay or non-delivery
Any defect not reported in accordance with these Conditions
All goods are supplied at the Buyer’s risk once delivered.
12. Ownership & Insolvency
Ownership of goods shall remain vested in Design Centre until:
Full payment has been received, and
All obligations under these Conditions have been fulfilled.
In the event of insolvency, liquidation, judicial management, or similar proceedings against the Buyer, Design Centre reserves the right to cancel any sale or suspend deliveries unless satisfactory security or advance payment is provided.
The Buyer undertakes to safeguard goods until repossession, if applicable.
13. Legal Costs & Jurisdiction
The Buyer agrees to be liable for all legal and debt-collection costs incurred by Design Centre in recovering outstanding amounts.
The parties consent to the jurisdiction of the Magistrates’ Court of Zimbabwe.
Design Centre reserves the right to institute proceedings in the High Court of Zimbabwe where appropriate.14. Privacy & Cookies
Use of this website is subject to Design Centre’s Privacy & Cookie Policy, which governs the collection and processing of personal information.
15. Waiver
No waiver, indulgence, or relaxation granted by Design Centre shall constitute a waiver of any rights unless confirmed in writing by a Director. All Conditions shall remain in full force unless formally amended in writing.
